Eligibility to Enter 

Entry is free to all current Australian residents aged 18 years or over who enter the Promotion following the terms and conditions of entry below and who are or become an email subscriber of Mountfords. 

Employees (and their immediate family and/or those living in the same household) of the Promoter, and its respective affiliates, subsidiaries, agencies, and suppliers associated with the Promotor are ineligible to enter.

How to enter

To enter the competition, the entrant must subscribe to Mountfords newsletter within the competition timeframe, via the social competition form, link in Instagram bio or website pop up, footer or sign up page.

The entrant must be subscribed to Mountfords between the outlined competition dates to be eligible to win.

Prize Details

There will be one (1) winner drawn at random. 

The prize for the competition winner consists of their choice of shoes on mountfords.com.au to the value of $1,000. The prize is not transferable, and we reserve the right to substitute any prize with another of equivalent value without giving notice.

All prices are in AUD currency. The size and colour of prize is subject to availability at the time of prize selection. 

Any residual value at the end of the winner’s transaction will be forfeited and will not be provided in cash or cash alternative. 

Determining the Winner 

This competition will run as a Game of Chance. The winner will be selected from a group of eligible participants through random electronic selection. The Promoter’s decision is final, and no correspondence will be entered into. 

Draw & Winner Notification

The winner will be drawn at random and take place at Munro Footwear Group, 28 Victoria Crescent, Abbotsford, Vic, 3067, Australia at 2pm AEDT or 4pm NZDT, Friday, 15 March 2024. The winner will be contacted via email from customercare@mountfords.com.au at 4pm AEDT or 6pm NZDT Friday, 15 March 2024. 

Unclaimed Prize Redraw

If a winner has not come forth to claim a prize/s within 3 months of the Draw & Winner Notification, an unclaimed prize redraw will be conducted at Munro Footwear Group (as above) at 1pm AEDT or 3pm NZDT Friday, 14 June 2024 by any State or Territory Regulations.

The redraw winner will also be contacted via email.

 

1.     By entering this competition, and by attempting to do so, each entrant agrees to be bound by these Terms and Conditions and expressly gives the consents referred to in these Terms and Conditions.  Any person who attempts to enter this competition shall be referred to in these Terms and Conditions as an “entrant” irrespective of whether any competition entry is accepted by the Promoter.

2.     The above table forms part of these Terms and Conditions and contains details concerning when, who, and how to enter; the time, place & method of prize selection; prize details; and who the Promoter is and any permit details.

3.     The Promoter, its associated agencies and companies, officeholders, management, employees, and contractors of the Promoter and its associated agencies and companies, and the immediate families of such employees are ineligible to win any prize.

4.     The Promoter’s decisions in relation to any aspect of this competition (including in relation to prize selections) are final and binding on each person who enters and no correspondence will be entered into. 

5.     Where possible, the winner/s will be notified via email, phone call, or via social media on the day of the draw. The name of the winner will be published on the Promoter’s website and social media account.

6.     The winner/s consents to their name, town/suburb of residence, social media handle (if relevant), and a photo of themselves being published by the Promoter including, but not limited to, being published on the Promoter’s Internet site, social media pages, in their stores and in marketing material for an unlimited time and without remuneration as a condition of acceptance of the prize. Further information will be published only with the permission of the winner.

7.     In the event the competition involves submitting content of any kind (including but not limited to photos, artwork, videos or audio recordings) (collectively referred to herein as “Content”), entrants grant the Promoter an irrevocable, perpetual, sub-licensable, royalty free, worldwide licence to use, copy, publish, reproduce, broadcast, edit, reduce to writing, create derivative works from, incorporate into any form and distribute the Content without compensation to the Entrant. Entrants warrant that the Content is their original work and does not violate any law or infringe any third party’s rights. 

8.     The prize/s cannot be exchanged for any other prize, and except in the case of cash prizes, cannot be exchanged or redeemed for cash. Prize/s are not transferable, changeable or exchangeable.  Any images associated with the prize/s are for promotional purposes only. Where applicable, prizes comprising of gift cards/vouchers are subject to the terms and conditions stated on those gift cards/vouchers. 

9.     The prize is subject to availability, the promoter will correspond directly with the prize winner to confirm prize details, full name, and postal address. The promoter will send out the prize pack directly to the winner's postal address and cover all costs associated with delivery. 

10.  Any change in value occurring between the publishing date and the date the prize is redeemed is not the responsibility of the Promoter. If a prize or any element of a prize is unavailable for any reason, the Promoter, at all times acting reasonably, reserves the right to substitute that prize or element with another item of equal or higher value as determined by the Promoter (acting reasonably), subject to the approval of any relevant authority if required.

11.  The Promoter reserves the right to verify the validity of entries (including an entrant’s identity, age and place of residence) and to disqualify any eligible entrant (and to prohibit that entrant from resubmitting an entry into the competition) where the Promoter believes that the entry or the entry process has been tampered with or where any entry has been submitted otherwise than in accordance with the Terms and Conditions. The Promoter may also disqualify any entrant who acts in a disruptive manner or who acts with intent or effect of annoying, abusing, threatening or harassing any other person or who behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, or who engages in conduct which is contrary to law or is otherwise inappropriate.

12.  Entries must not include any content that contravenes any law, infringes the rights of any person or is obscene, offensive, potentially defamatory, discriminatory, indecent, objectionable or inappropriate (which includes any content involving nudity, malice, excessive violence or obscene language).

13.  If for any reason (including due to tampering or interference) this competition is not capable of running as planned, subject to the approval of those authorities which have issued permits for the conduct of this competition, the Promoter, at all times acting reasonably, reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

14.  The Promoter accepts no responsibility for any lost, late, misdirected entries, illegible entries (including lost, stolen, forged, defaced or damaged entries) or entries deemed ineligible due to incorrect entrant information. The Promoter will not accept entries which are incomplete, illegible, or which are generated by computers or other automated means.

15.  The Promoter assumes no responsibility for any error, omission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries. The Promoter is not responsible for any problems or technical malfunction of any equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participation or downloading any materials in this competition.

16.  The Promoter will take all necessary steps to ensure that entries are properly recorded and stored, but will accept no liability if an entry is not recorded or is lost.

17.  The Promoter will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or personal injury suffered or sustained arising from or in connection with the competition, any omission to enter a person into the competition, acceptance of the prize or the prize itself, except for liability which cannot be excluded by law. The winner releases the Promoter, its related bodies corporate, affiliates, officers, agents, employees and suppliers (the “Released Parties”) from all liability, loss and damage of any kind arising out of or in connection with the acceptance of, and participation in, any prize. Without limiting the foregoing, the Released Parties will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).

18.  The Promoter is not liable for any tax implications arising from any prize winnings. Independent financial advice should be sought by the prize winner if necessary. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length goods and services exchanged are of equal GST-inclusive market values.

19.  The competition is in no way sponsored, endorsed or administered by, or associated with META (Facebook or Instagram).  Entrants are providing their information to the Promoter and not to Facebook or Instagram.  Each entrant agrees to completely release Facebook and Instagram from any and all liability in connection with this competition. Any questions, comments, or complaints about this competition must be directed to the Promoter and not to Facebook or Instagram.

20.  The Promoter collects and uses personal information ("PI") in order to conduct the competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers, and as required, to any applicable regulatory authorities. By entering this competition and providing your PI, you agree to such disclosure. Although you may choose not to provide certain information, please be aware that this may affect your eligibility to win the competition.

21.  The Promoter uses and manages the entrant’s personal information in accordance with Mountfords Privacy Policy which can be found at https://www.mountfords.com.au/privacy-policy

22.  The Privacy Policy contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the applicable Privacy Principles or any other applicable law and how those complaints will be dealt with.  

23.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, each entrant consents to the Promoter, for an indefinite period, unless otherwise advised in writing by the entrant, using the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to or telephoning the entrant. Entrants can request not to receive information about future promotions by unsubscribing from email communications. The Promoter may continue to provide entrants with information for an indefinite period unless and until advised otherwise by the entrant.

24.  These Terms and Conditions are governed by the laws of Victoria, Australia. Entrants submit to the exclusive jurisdiction of the courts of Victoria, Australia.

 

Terms and Conditions of Munro Footwear Group Customer Feedback Promotion.

1.    Information on how to enter and the prize form part of these Terms and Conditions. Participation in Munro Footwear Group Customer Feedback Competition ("Competition") is deemed acceptance of these Terms and Conditions.

Promoter

2.    The promoter is Feedback ASAP Pty Ltd (ABN 53 146 056 331) St Kilda Rd Towers, Level 1, 1 Queens Road, Melbourne Victoria 3004.

Competition Period

3.    The period of this Competition begins at 12:00:00am (AEDT) on 1st of January 2024 and ends at 11:59:59pm (AEST) on 30th June 2024. (“Competition Period”). 

Eligibility to Enter

4.    Entry is only open to Australian residents aged 18 years and over who are current and former customers of Munro Footwear Group brands which include Midas, Cinori, Mountfords, Williams, Mathers and Big Brand Shoe Clearance have received a promotional SMS or email from the Promoter.

5.    Employees (and their Immediate Family Members) of the Promoter or of Munro Footwear Group, or any related body corporate of the Promoter or Munro Footwear Group as well as any agency associated with this Competition are ineligible to enter. Immediate Family Members means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child, or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.

How to Enter

6. To enter the Competition, an eligible entrant must complete one of the following mechanics during the Promotional Period:

(A)  Email Entry: (i) click on the link provided in the email that they receive from the Promoter to be directed to the promotional website; and (ii) input the requested personal details and answer all the questions in the survey as prompted on the promotional survey and submit the fully completed survey.

(B)  SMS Entry: (i) click on the link provided in the SMS that they receive from the Promoter or via text instructions on the feedback cards provided in selected stores to be directed to the promotional website; and (ii) input the requested personal details and answer all the questions in the survey as prompted on the promotional website and submit the fully completed survey.

7.    For the sake of clarity, the entrant will be the person whose name is registered on the Munro Footwear Group brands (Midas, Cinori, Mountfords, Williams, Mathers, and Big Brand Shoe Clearance) account relevant to the mobile phone number submitted on entry (for 1800 entry), the mobile phone used to enter (for SMS entry), or email address (Website Entry)

8.    Only one (1) entry permitted per feedback request.

Prize Draws

9.     Entries open and close for the draws on the dates and times specified in the table below. The prize draws will be conducted by Feedback ASAP Pty Ltd, St. Kilda Rd Towers, Level 1, 1 Queens Road Melbourne, Victoria 3004 at 12noon on the dates specified in the table below:

10.     The winner of each prize draw period will be notified by telephone or email within two (2) days of the draw. If the winner location is in the ACT they will be contacted by mail. The winner’s name will be published www.munrofootweargroup.com.au within 7 days of the relevant draw.

Prize

11.     Each valid entry drawn from the prize draws will win a $1,000 Mastercard Gift Card.

12.     The Mastercard Gift Card will be posted to the winner by registered mail and is valid until the date shown on the front of the Card. The Mastercard Gift Card is subject to its terms of issue and may not be accepted by all retailers. The Promoter accepts no liability for a defective Gift Card however, if necessary, will provide reasonable assistance to a winner to ensure a replacement Mastercard Gift Card is provided.

13.     Any ancillary costs associated with redeeming the Mastercard Gift Card not included. Any unused balance of the Mastercard Gift Card will not be awarded as cash. Redemption of the Mastercard Gift Card is subject to any terms and conditions of the issuer including those specified on the Mastercard Gift Card.

Unclaimed Prize Draw

14.     If a prize is still unclaimed after three calendar months of the original prize draw, the Promoter will conduct a further draw for the prize, subject to any directions from any regulatory authority. The unclaimed prize draws will be conducted at the same time and place as the original draws. The dates for these additional draws would be on 09th July 2024, and 09th Oct 2024.

15.     The winner of an unclaimed prize draw will be notified by telephone or email within two (2) days of the draw. If the winner location is in the ACT they will be contacted by mail. The winner's name will be published on www.munrofootweargroup.com.au within 7 days of the prize draw.

General

16.     This is not a game of skill. The prize winners will be selected by Feedback ASAP Pty Ltd at random through an automatic selection process.

17.     Incomplete entries will be deemed invalid and removed from the draws. The promoter's decision is final, and no correspondence will be entered into.

18.     The total value of the prize pool is AU$2,000.

19.     The prize is not transferable or exchangeable and cannot be taken in any other form (including not being able to be taken as cash).

20.     Subject to the unclaimed prize draw clause 14, if for any reason a winner does not take possession of their prize by the times stipulated by the Promoter, then the prize will be forfeited.

21.     The draw will be conducted by Feedback ASAP, St. Kilda Rd Towers, Level 1, 1 Queens Road Melbourne, Victoria 3004. 

22.     Any entrant (who the Promoter automatically enters the Competition when they provide Feedback) who no longer wishes to participate in the Competition can email support@feedbackasap.com and request for their entry to be removed from the relevant draw.

Liability, Indemnity and Warranties   

 23.    Subject to regulatory requirements, the Promoter may cancel, modify, suspend or delay the Promotion at any time if something happens that is beyond its reasonable control, including for any technical or operational reason or by reason of anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion.

24.     Costs associated with completing the survey remain your responsibility and may vary depending on the telecommunications provider used.

Privacy

25.     The Promoter may collect and use personal information submitted by you for the purpose of conducting the Promotion. Personal information may be provided to third party organizations, including but not limited to agents, contractors and service providers that assist in maintaining the survey functionality and/or conducting the Promotion, and, if required may be provided to Australian regulatory authorities. You can stop this information being used for this purpose by contacting the Promoter. All personal information will be stored at the office of the Promoter.
